Homeschooling in the USA: how to start and what your state expects
Homeschooling is legal in all fifty states, and has been since the early 1990s. That is the settled part. Everything after it varies, because education law in the US is written at state level, and two families four hours apart can face completely different paperwork.
This is general information, not legal advice. Homeschool requirements vary by state and they change. Confirm the current rules with your own state department of education or a state homeschool organization before you withdraw a child.
Work out which state you are actually in
This sounds obvious and it is the step people skip. The rules that apply to you are the rules of the state where the child resides, not the state you grew up in, not the state your curriculum publisher is based in, and not the state described in the blog post you read at midnight. States sit somewhere on a spectrum from no notice at all to annual notice, standardized testing, portfolio review and required subjects. Some also offer more than one legal route, such as filing as a home school, enrolling in an umbrella school, or operating as a private school, and the route you pick changes what you owe.
Withdrawing from your school district
- Find out what your state requires before you tell the school anything. Filing in the wrong order causes most of the friction families report.
- Send written notice of withdrawal to the school, keeping a copy and proof of sending. Email with a receipt or certified mail both work.
- File a notice of intent with the district or state, if your state requires one, by the date it requires.
- Keep everything you send and receive in one folder. Truancy questions are far easier to answer with dated paperwork than with a good memory.
- Start your record on day one, even a line a day. Reconstructing a semester four months later is the most miserable job in homeschooling.
If your child receives special education services under an IEP or a 504 plan, get specific advice before you withdraw. Those services generally do not transfer intact to a homeschooled child, and what a district must offer changes once homeschooling is your choice. This is the one situation where reading another page before acting is worth it.
The first semester
Most new homeschoolers try to rebuild school at the kitchen table, with a bell schedule and subjects in hour blocks. It usually collapses inside a month, and the collapse feels like personal failure when it is a scheduling error. One to one is far more efficient than one to thirty: no attendance taking, no lining up, no settling a room, no waiting for anyone else. What fills an hour in a classroom often takes fifteen minutes at home. For elementary grades, one to two hours of focused work plus reading and activity is normal and sufficient.
If your child left school unhappy, expect a gap first. A period of very little formal work, often called deschooling, is not lost time. The association between learning and anxiety fades during it, and pushing academics through that window tends to extend it.
What to ignore in year one
- Boxed curriculum bought before you know how your child learns at home. You have not met that version of them yet.
- Grade level comparison. Uneven is normal and rarely means what people fear it means.
- Anyone insisting there is one correct method. Structured, interest led and everything in between all work.
- Buying equipment. A library card and a notebook cover most first semesters.

Common questions
Do I need a teaching certificate to homeschool?
In most states, no. A handful set a minimum such as a high school diploma or GED for the teaching parent. Check your own state, because this is one of the requirements that differs most and is quoted wrongly most often.
Can my child play school sports or take a class at the public school?
It depends on your state and often on the individual district. Some states have laws granting homeschoolers access to activities and part time classes, others leave it to the district, and some do not allow it. Ask the district directly and get the answer in writing.
What if we move to another state?
You switch to the new state’s requirements, usually from the point you establish residence. File whatever the new state needs promptly, and keep your existing records, since a continuous dated log is the fastest way to satisfy a new authority.
